Complex litigation refers to high-stakes civil lawsuits that involve multiple parties, intensive judicial management, and massive amounts of data.

Common complex litigation cases include class actions, mass torts, multidistrict litigation (MDL), antitrust, intellectual property disputes, securities litigation, commercial disputes, and environmental and toxic torts. Of all pending federal civil dockets, 65% to 70% involve coordinated multi-party/mass tort litigation centralized through MDLs. These types of cases routinely require dozens of law firms, clients, experts, and other parties to coordinate simultaneously. Yet much of the work that moves those cases forward does not live on the court docket or within any single firm’s case management system. Correspondence, negotiated protocols, working deadlines, discovery exchanges, client updates, and other critical information are instead spread across email chains, file-sharing tools, and firm-specific systems. As a result, plaintiffs’ law firms appointed by the federal judges and national coordinating counsel hired by large enterprise companies to lead complex cases often lack the visibility and control required to direct and manage massive litigation effectively.
The coordination burden grows quickly with case size. Clarra finds that an average MDL can involve 14 law firms, while the largest mass tort matters may involve more than 100. With that many teams working across separate systems, attorneys can lose two to four hours each week just keeping information aligned, while various versions of the same critical document may be circulating at once.
